Although the law requires applicants receive credit for prior creditable coverage, those applicants lacking prior creditable coverage may be subject to a 6 month look back, 12 month exclusionary period on pre-existing medical conditions. Coverage may also be modified by the use of elimination riders. An elimination rider is used to temporarily or permanently eliminate the coverage of specific medical conditions. Because there are differentiating factors used when determining rates, the premiums for individual health plans may vary.

For purposes of obtaining employer-sponsored medical coverage, the State of Wyoming defines a small group as a group of employees numbering 2 to 50. Wyoming insurance regulations, in accordance with the Health Insurance Portability and Accountability Act of 1996, require that group health benefits must be offered on a guarantee issue basis. Issuance of coverage under this process provides that no group may be declined medical insurance coverage based upon the past or current health status of the group or individual employee. Group applicants lacking prior creditable coverage or whose prior coverage has a break of more than 63 days, are subject to a 6 month look back, 12 month exclusionary period on all pre-existing medical conditions. The process of medical underwriting is permitted in the determination of group health premium rates and may cause for a variation of plus or minus 30 percent of the indexed group rates.

Under federal COBRA, an employee may remain on the employer sponsored plan for 18 months following the termination of their group health coverage. Wyoming has a mini-COBRA regulation which applies to groups of less than 20 employees. The Wyoming mini-COBRA regulation allows an employee to remain on the group health plan for an additional 12 months. Election of your continuation of coverage must be made within 31 days of the termination of your group health plan coverage. Under Wyoming's mini-COBRA law, cost for the continuation of coverage is the sole expense of the beneficiary. The Wyoming Health Insurance Pool offers guaranteed issue medical coverage for persons exhausting their COBRA benefits that are not eligible for standard issue individual coverage.
