What are the tax benefits for Medical Care Insurance in Wisconsin as of 2008?

Medical care insurance in general connotes a medical care insurance policy that covers you, your spouse and dependents. It provides medical, surgical, hospital, major medical and other health care coverage.

As a general rule, if you are employed and your employer does not pay any portion of the cost of your medical care insurance, then you may subtract 100% of the amount paid for the insurance plan. If on the other hand, your employer pays any portion of your medical care insurance then you may subtract ten percent of the amount that person paid for insurance in 2008. Such percentage shall increase to 25% for 2009, 45% for 2010, and 100% for 2011.

If you are not self-employed and you do not have an employer, then you can subtract 66.7% of the amount paid for the medical care insurance in 2008. This percentage shall increase to 100% by 2009. The amount to be subtracted cannot be more than the amount of the person’s earned and unearned income.

As an employee, you generally cannot claim a subtraction for the medical care insurance cost if such cost is provided under an employee reimbursement account, a flexible spending account or a similar arrangement.

For the self-employed, you can claim a Wisconsin subtraction of 100% of the medical care insurance cost. But such Wisconsin subtraction must be reduced by the amount claimed on the federal return as a self-employed health insurance deduction. This procedure prevents a double deduction as the deduction is carried over to the Wisconsin return.
