We are a Canadian couple expecting twins in the near future through a surrogacy arrangement in California. Is there an insurance plan available for the babies that would take effect right after birth that would cover the hospital stay costs and also in particular a plan that would cover the stay should the babies be born premature? Also if one of the babies were born with a condition requiring a hospital stay is there a insurance plan available that would cover this right after or soon after birth?

We are not aware of any insurance company in California that will insure only an unborn child. In fact, several require that a newborn be at least 30 days old and free of health concerns before they will issue a “child only” policy. California allows medical underwriting for individual health insurance policies. This means that they may deny coverage to persons that have pre-existing medical conditions or a health history that they consider high-risk. It would be impossible for the insurance companies in California to underwrite and unborn child in order to determine the risk factors in issuing coverage.

If the surrogate has private health insurance, you need to thoroughly review her coverage or have her speak with her insurance company about including the newborns throughout their hospital stay. Many plans exclude this, but it is definitely something you will want to investigate.
